Please read these Terms of Service ("Terms") carefully before using SpicySwingers ("the Platform", "we", "us", "our"). By accessing or using the Platform in any way, you agree to be bound by these Terms in full. If you do not agree, you must not use the Platform.

1. About the Platform

SpicySwingers is an online community platform for consenting adults interested in the lifestyle community. The Platform provides tools for members to connect, communicate, and meet with other like-minded adults.

2. Eligibility

2.1 You must be at least 18 years of age to register or use the Platform. By registering, you confirm that you are 18 or over.

2.2 You must be legally permitted to access adult content in your jurisdiction. It is your responsibility to ensure your use of the Platform complies with the laws of your country or region.

2.3 We reserve the right to request proof of age at any time and to terminate any account where we have reason to believe the user is under 18.

2.4 By registering, you represent and warrant that all information you provide is accurate, current and complete.

3. Account Registration

3.1 You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any other person.

3.2 You are solely responsible for all activity that occurs under your account.

3.3 You must notify us immediately at hello@spicyswingers.com if you suspect any unauthorised use of your account.

3.4 We reserve the right to refuse registration, suspend, or permanently ban any account at our sole discretion, with or without notice and with or without reason.

4. Acceptable Use

4.1 You agree to use the Platform only for lawful purposes and in accordance with these Terms.

4.2 You must not:

Post, upload or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
Post any content depicting or suggesting sexual activity involving anyone under the age of 18
Impersonate any person or entity or misrepresent your identity or affiliation
Solicit money or financial benefit from other members
Advertise escort services, paid sexual services, or any commercial sexual activity
Spam, harass, or send unsolicited messages to other members
Collect or harvest personal data about other members without their consent
Attempt to gain unauthorised access to any part of the Platform or its systems
Upload malware, viruses, or any code designed to damage or interfere with the Platform
Use automated scripts, bots, or scrapers on the Platform
Share another member's private information, photos, or content without their explicit consent
Use the Platform for any commercial purpose without our prior written consent

5. Content

5.1 You retain ownership of content you post on the Platform. By posting content, you grant SpicySwingers a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, adapt, publish, translate, distribute and display that content in connection with operating and promoting the Platform.

5.2 You are solely responsible for all content you post. We do not endorse, verify, or take responsibility for any user-generated content.

5.3 We reserve the right to remove any content at any time without notice, at our sole discretion.

5.4 Adult content is permitted on the Platform subject to our content guidelines. All individuals depicted in any content you upload must be 18 or over. By uploading content depicting other individuals, you confirm you have their explicit consent.

5.5 You must not upload content that was taken or shared without the subject's consent. Non-consensual intimate image sharing is a criminal offence and will result in immediate account termination and referral to the relevant authorities.

6. Member Interactions

6.1 We are not responsible for the conduct of any member online or offline. Any meeting or interaction you arrange with another member is entirely at your own risk.

6.2 We strongly encourage members to exercise caution when meeting people they have connected with online. Always meet in public first and tell someone where you are going.

6.3 We do not verify the identity of members beyond the verification tools available on the Platform. Member verification badges indicate peer verification only and do not constitute our endorsement of any individual.

6.4 We are not a party to any arrangements made between members and accept no liability for any loss, harm, or damage arising from member interactions.

7. Premium Membership

7.1 Certain features of the Platform are available to premium subscribers only. Premium membership is offered on a subscription basis.

7.2 All payments are processed by our third-party payment provider. By subscribing, you agree to their terms and conditions.

7.3 Subscriptions automatically renew unless cancelled before the renewal date. It is your responsibility to cancel before renewal if you do not wish to continue.

7.4 We do not offer refunds for unused subscription periods except where required by applicable law.

7.5 We reserve the right to change subscription pricing at any time. We will provide reasonable notice of any price changes.

8. Intellectual Property

8.1 All content, design, software, trademarks, and other intellectual property on the Platform (excluding user-generated content) is owned by or licensed to SpicySwingers.

8.2 You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

9. Privacy

9.1 Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.2 By using the Platform you consent to the collection and use of your data as described in our Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 To the fullest extent permitted by applicable law, SpicySwingers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or personal injury, arising from your use of or inability to use the Platform.

10.3 We are not liable for any content posted by users. We are a platform provider and not a publisher of user-generated content.

10.4 Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

10.5 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless SpicySwingers and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third party rights.

12. Termination

12.1 We may suspend or terminate your account at any time, for any reason, with or without notice.

12.2 You may delete your account at any time through the account settings page. Upon deletion, your data will be retained for 30 days to allow for account recovery, after which it will be permanently deleted.

12.3 Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the relevant courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpicySwingers regarding your use of the Platform and supersede all prior agreements.
